Donald L. Nicholas
Mr. Nicholas, who is Of Counsel in the firm, joined Costello, Cooney & Fearon, PLLC in 1968. His primary work is currently in the area of health care law. Mr. Nicholas counsels health care organizations and physician practices in the areas of medical staff matters, patient rights, reorganization, health care corporate matters, fraud and abuse, federal compliance and tax issues.
His practice also includes involvement in real estate litigation, mortgage foreclosure and tax assessment litigation. He also has significant appellate experience in these areas.
He has lectured at health care meetings on the effect of the COBRA (patient dumping) legislation and case law; on the new guardianship laws and their effect on health care institutions; on patient proxy law and living wills; on current legal issues effecting physician practices and other matters.
In 1960, Mr. Nicholas graduated from LeMoyne College in Syracuse. In 1966, he earned his J.D. from the Syracuse University College of Law where he was a member of the Justinian Honor Society and Order of the Coif, and served as articles editor for the Syracuse Law Review. He is admitted to practice before all New York State Courts, the U.S. District Court for the Northern District of New York and U.S. Tax Court.
Mr. Nicholas is a member of the Onondaga County and New York State Bar Associations. He has served as an adjunct professor of law at the Syracuse University College of Law. He is also a member of the Catholic Lawyers Guild and served as a director of Catholic Charities.
