Robert W. Connolly
Mr. Connolly joined the firm in 1995 after serving under Federal Judge David N. Hurd in the Federal District Court for the Northern District of New York and has been a partner since 2001. He concentrates in the areas of hospital and healthcare law, guardianships, mental health law as well as complex commercial and business litigation. He is versed in both federal and state practice. He has extensive trial experience with both jury and non-jury matters in counties throughout New York State and has successfully handled appeals in the third and fourth departments. Mr. Connolly has lectured on numerous topics in healthcare as well as litigation fields.
Mr. Connolly holds a bachelor's degree from Boston University and a juris doctor from Albany Law School of Union University. He has also received the privilege of publication in the Albany Law Review and was honored with citation by the National Law Journal.
Mr. Connolly has been admitted to the New York and Massachusetts Bars as well as the Federal Bar for the Northern District of New York. He is a member of the Onondaga County, New York State and American Bar Associations and a section member of the New York State Bar Health Law and Tort Trial Insurance Practice Sections.
Represented several regional hospitals in all legal matters related to mental health and mental hygiene rights of patients, including court hearings for treatment, electroconvulsive therapy and retention.
Represented hospitals in court hearings for major medical treatment over objection, including the amputation of a gangrenous limb, and the insertion of a tracheostomy tube.
Represented hospitals and individuals in numerous court petitions for guardian of the person or property for the purpose of healthcare decision-making or estate proceedings.
Counseled regional hospitals and healthcare entities regarding a wide range of issues arising from Privacy, HIPAA and HITECH protections.
Drafted, negotiated and reviewed business associate agreements for multiple healthcare entities and businesses.
Drafted, negotiated and reviewed contract documents related to the purchase of healthcare practices.
Represented major corporations in defense of surety bond claims arising out of multimillion dollar construction project.
Drafted and reviewed construction contracts for design-builders, construction managers, subcontractors and architects related to various jobs ranging in size from one million to 250 million.
Represented public administrator in range of estate litigation in surrogate court ranging from applications for testamentary authority to turnover proceedings to hearings regarding accounting disputes.
Tried multiple jury trials to successful completion addressing tort, contract, personal injury and property damage issues.
Counseled clients on a broad range of privacy and healthcare decision-making issues ranging from end of life decisions to disclosure of healthcare information for law enforcement.
